Terms & Conditions for All Users
  1. POW WOW Communications (BN 98 200746) is an online service owned and operated by The Building Centre Network (ABN 57 174 102 507).  POW WOW is hosted on the www.buildingcentre.com website.  POW WOW Communication’s Terms & Conditions are designed to assist you with your satisfaction and understanding of the Event Listing &/or Purchase process on the POW WOW section.  These Terms & Conditions represent a legally enforceable agreement with POW WOW Communications.  By accessing and using the POW WOW section of the website you agree that your access and use is governed by these Terms & Conditions.  Your use by accessing, browsing, opening or otherwise using any section of the website is verification of your acceptance of these Terms & Conditions.
  2. For the purposes of these Terms & Conditions, a Listing on the POW WOW section is defined as an item of information published within the relevant categories on the POW WOW section of the www.buildingcentre.com website, while an Event is defined as something that happens at a given place and time, that is also published within the relevant categories on the POW WOW section of www.buildingcentre.com website.
  3. POW WOW Communications hopes to make your event listing &/or ticket purchase as easy as possible, so that you can attend your event as quickly as possible.  If you have any questions regarding POW WOW’s Terms & Conditions or anything contained on the POW WOW section please contact us by emailing This e-mail address is being protected from spam bots, you need JavaScript enabled to view it .  Each ticket purchase or enrolment is a license to attend that particular event or activity, and is subject to the additional terms set out on that ticket.
  4. POW WOW provides a platform so that Event and News Providers may list items and/or sell tickets.  In return for this service, POW WOW charges a listing fee and also retains a booking fee as negotiated when a ticket is purchased via the POW WOW booking service.  POW WOW Communications sells tickets and enrolments on behalf of ‘Event Providers’ and venues, which means POW WOW Communications does not set the ticket or enrolment prices or determine seating locations.  Tickets or enrolments are sold online via the POW WOW section.  Occasionally, extra tickets may be available prior to the event.  POW WOW Communications does not control the number of tickets to an event or their availability.
  5. All ticket or enrolment prices for events that occur in Australia are stated in Australian Dollars.  POW WOW Communications accepts several methods of payment including: Pay Pal (including Visa & Mastercard) online or via telephone American Express, MasterCard, Diners and Visa.
  6. POW WOW Communications acts as an agent for those who are promoting or otherwise providing the events for which you purchase tickets or enrolments.  When purchasing a ticket for an event or course that is located in Australia, then POW WOW Communications will be handling the transaction and collecting payment for the Event Provider, and if the tickets are sent they will be sent from Australia.
  7. If you do not receive a confirmation number (in the form of a confirmation page or email) after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with POW WOW Communications whether or not your order has been placed.  You may be the only person aware of any problems that may have occurred during the purchase process.  POW WOW Communications will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation, or if you assume an order was placed, however you also failed to receive confirmation or advice to support that status.
  8. Tickets purchased or enrolments made via the POW WOW section are subject to an individual ticket charge only per order.
  9. Before purchasing tickets or enrolments, carefully review your event.  Policies set out by event providers, including venues, generally prohibit POW WOW Communications from issuing exchanges or refunds after a ticket has been purchased or for lost, stolen, damaged or destroyed tickets.
  10. By purchasing a ticket or enrolment through POW WOW Communications, you agree to the Terms & Conditions on behalf of yourself and any accompanying minor.  You assume all risks supplementary to the event for which a ticket or enrolment is issued, whether before, during or after the relevant event.  Ticket sales facilitated by POW WOW are done so on behalf of the event organiser and are subject to the conditions applicable to that activity and associated venue.
  11. Occasionally, events are cancelled or postponed by the promoter or venue due to weather conditions or situations affecting the staff or audience.  When this occurs, POW WOW Communications makes every effort to make sure you receive a prompt refund if applicable.  If an event is cancelled, please contact us for information on how to receive a refund from the Event Provider.  If the event was moved or rescheduled, the venue or promoter may set refund limitations.  An event’s advertised program is not guaranteed, and the event organiser retains the right to vary this at any time.  Please contact us for relevant advice.  Make sure to include your POW WOW booking reference number so we can speed up your refund if applicable.
  12. Orders are processed only after a billing address, and other billing details, have been confirmed.  Occasionally, POW WOW Communications may receive incorrect billing or credit card account information for a ticket purchase that can delay processing and delivery.  In these situations, we will attempt to contact you, using the details provided at the time of purchase.  If POW WOW Communications is unable to reach you after its initial attempt, we may cancel your order and may sell your tickets or enrolment to another customer.
  13. It is important to note that customers purchasing tickets or enrolment to an event understand that lost, stolen or destroyed tickets for these events may NOT be replaced under any circumstances.  This includes tickets that do not arrive in the mail.  To safeguard your tickets you may choose to have them sent by Registered Post at an additional cost of $3.50.  Tickets or enrolments sent by normal mail delivery cannot be traced and no responsibility will be taken for tickets sent by this method.  Alternatively your tickets may be collected from the venue on the day of the performance.  Tickets delivered through Pick Up at the venue are typically available one hour prior to the event time.  You will need to present your POW WOW Communications confirmation number and picture identification.  In some instances where a venue collection is not available, alternative arrangements may be offered.  Please check the purchase page for the relevant event.

    If you have selected delivery through the mail, please allow at least 14 days after your order is made to receive your tickets.  POW WOW Communications can send tickets via Express Post in Australia to the billing address of the charge card holder, for an additional cost of $5.50.
  14. If the amount paid for a ticket is incorrect regardless of whether it was due to an error in a price displayed on the POW WOW section or otherwise communicated to you, or you are able to order a ticket before its scheduled on-sale or presale date, then POW WOW Communications will have the right to cancel that ticket and refund to you the amount that you paid.  This will apply regardless of whether it was because of human error or a transactional malfunction of the POW WOW section or other POW WOW Communications operated system.
  15. When ordering tickets online with POW WOW Communications, please ensure you are looking for tickets and placing an order using only one browser window.  Looking up tickets using multiple browser windows could result in losing your tickets or website timer expiration.
  16. Event Providers reserve the right, without refund of any amount paid, to refuse entry to, or eject, any person whose conduct is improper, who uses vulgar or abusive language or who fails to comply with Event Provider rules.  Violation of terms or rules will terminate your license to attend the event without refund.  A ticket is a revocable license and entry may be refused upon refunding the ticket's face amount.  Tickets are not redeemable for cash.
  17. Concession tickets purchased online will require relevant ID when presented to the event organiser. If relevant ID cannot be presented admission may be refused by the event organiser.
  18. For security reasons you and your personal effects may be searched on entry.  You consent to such searches and surrender any related claims that may arise.  If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation.  Under certain venue rules, various items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, and containers.
  19. You agree not to record or transmit any description, account, picture, or reproduction of the event.  You grant permission to utilise your image, likeness, actions and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event in any medium or context without further authorisation or compensation.
  20. Unauthorized resale of tickets is grounds for seizure and cancellation without any compensation.  A ticket is not to be used for advertising, promotions, contests or sweepstakes, unless the Event Provider gives formal written authorisation, and that even if such consent is obtained, use of POW WOW Communications trademarks and other intellectual property is subject to POW WOW Communication's permission.

POW WOW Communications will not be liable to you for any indirect, substantial, exemplary, minor, exceptional or disciplinary damages, or for lost profits, revenues or business opportunities, even if POW WOW Communications has been advised of the possibility of such damages.

By using the POW WOW section of www.buildingcentre.com you agree to indemnify and hold POW WOW Communications and its affiliates, and each of POW WOW Communication's and its affiliates' respective officers, agents, employees, contractors and principals, risk-free from any loss, liability, claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the website, including also your use of the website to provide a link to another site or to upload content or other information to the website.

It may take up to five (5) working days for event listings to be processed, edited and approved.

Unless otherwise stated, POW WOW Communications owns or has a valid licence to use all copyright in the content of the POW WOW website and trade marks used on the POW WOW website.

You must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, frame or embed in another website or distribute in any way any content contained on or in the Site and owned or licensed by POW WOW Communications, except as expressly approved by us in writing or as permitted under the Copyright Act 1968.

POW WOW grants permission to do the following with the material on the Site:

(a) store a reproduction of the material on your local computer for the sole purpose of viewing the material;

(b) print hard copies of material for your personal information, but not commercial use.

 
Listing Terms & Conditions

POW WOW acts as an agent and information medium only. The event organiser provides services to customers directly.  POW WOW makes no guarantees about the services that are provided to you by the event organiser.  POW WOW has no liability for any act, omission or default, whether negligent or otherwise, of any service provider.  POW WOW has no liability for any loss or damage occasioned by any negligent act or omission of any service provider or third party.  Where POW WOW's liability cannot be excluded, such liability is limited to the value of the ticket purchased.

Terms & Conditions Specific to Event & News Item Providers

By listing an event on the POW WOW section of www.buildingcentre.com you accept the following terms and conditions.

  1. POW WOW assumes no responsibility for any error, omission, interruption, deletion, defect, delay in transmission, downtime or line failure.
  2. Your use of the POW WOW web site is at your sole risk.
  3. Details on this website may be changed, updated, modified and/or deleted at any time.
  4. POW WOW reserves the right to distribute an event organiser’s contact details as required.
